The apex court, in a judgement delivered by Justice Emmanuel Agim but written by Justice Garba Lawal today in Abuja, declined to order the release of Kanu.
The Biafran separatist, who is also a British citizen, was arrested by the administration of former president Muhammad Buhari in 2015 and was granted bail in 2017. He escaped to London after Nigerian security forces invaded his home in Afara-Ukwu in Umuahia, Abia State in 2017.
In 2021 the Federal Government extradited Kanu from Kenya in a manner that was widely condemned as spite on international laws.
Appeal Court, in October 2022, discharged and acquitted Nnamdi Kanu but Buhari-led administration immediately filed appeal at the Supreme Court to prevent his release.
Then today, the apex court set aside Appeal Court ruling on the ground that Kanu cannot be acquitted of terrorism charges against him on “mere” fact that Federal Government recklessly violated his human rights.
